The magnetic flux that appears in Faraday's law is integrated over any OPEN surface which is bounded by the loop of conductor in question. The fact that it is NOT A CLOSED surface means that we escape the clutches of Gauss' law for B which always requires the magnetic flux over a closed surface to be zero.
